1.General provisions
The present general sales conditions (hereafter referred to as the “General Conditions”), define and fix the contractual conditions between any buyer acting as a consumer (hereafter referred to as the “Consumer” or “You”) who places an order for products (hereafter referred to as the “Products”) by telephone, e-mail, mail or on the website with the company J&S Led, acting under the trade name Power Led, a limited liability company with a capital of 7. 500, whose registered office is located at 375 Montée des Hauvets – 26190 La Motte-Fanjas – FRANCE, registered in the Romans sur Isère Trade and Companies Register under number 8833567621.

These general terms and conditions of sale exclusively govern the sales of Products to Consumers. Only a natural person acting for private purposes or for purposes that do not fall within the scope of a commercial, industrial, craft, liberal or agricultural activity shall be considered as a “Consumer” within the meaning of these terms and conditions.
The General Terms and Conditions in force are those in force on the day of the Consumer’s order, in particular those posted on the powerled-horticole.com website. Powerled-horticole.com reserves the right to adapt, modify or update these General Terms and Conditions. In the event of adaptation, modification or update, the General Terms and Conditions in force on the day of the order will be applied to the order.
Any order of Products from Powerled-horticole.com by a Consumer implies the unreserved acceptance of these General Terms and Conditions, in particular by clicking on the box provided for this purpose in the case of an order on the website.
Consequently, the fact of placing an order for Products with Powerled-horticole.com implies the Consumer’s express and unreserved acceptance of these General Terms and Conditions.
The present General Terms and Conditions are in any case available and can be consulted on the website.
The fact of not exercising at any time a prerogative recognised by the present General Terms and Conditions, or of not requiring the execution of any stipulation of the agreement resulting from the said terms and conditions may in no case be interpreted, either as a modification of the said agreement, or as an express or tacit renunciation of the right to exercise the said prerogative in the future, or the right to require the scrupulous execution of the commitments subscribed to the present.
The Consumer declares that he/she is legally capable of entering into this contract, the General Terms and Conditions of Sale of which are set out below, i.e. that he/she is of legal age and is not under guardianship or trusteeship.
2.Placing an order

In general, and in the extension of the provisions indicated below, the validation of an order by the Consumer is subject to the complete payment of its price.
It is furthermore specified that Powerled-horticole.com reserves the right to refuse any order from a Consumer for legitimate reasons, in particular in the case where there is a dispute relating to the payment of a previous order and/or non-compliance with these General Terms and Conditions.
2.1 Orders on the Website
The Consumer places an order on the website by following the procedure provided for this purpose on the website.
To this end, the Consumer must provide information concerning him/her and fill in an online form accessible on the Website. Certain information is mandatory, in particular to enable the Consumer’s order to be carried out.
The Consumer is solely responsible for the information he/she has entered when placing his/her order, so that Powerled-horticole.com shall not be held liable for any shortcomings or delays in the delivery of the products ordered due to an error in the information provided.
Once the Products of his/her choice have been selected on the website, the Consumer has the possibility to check the details and the total price of his/her order, to correct any errors, before validating the order for acceptance.
After accessing a summary screen, the Purchaser validates his/her order by clicking on the “Validate my order” button.
Once his order is validated, the Consumer proceeds to the payment of his order by clicking on the button “Pay my order” and according to the payment methods proposed.
This action is assimilated to the handwritten signature referred to in Articles 1174 and 1359 et seq. of the Civil Code and the conclusion of a commitment in electronic form within the meaning of Articles 1128 et seq. of the Civil Code. As of this action :
the Consumer confirms his order and declares to accept it, as well as the entirety of these General Conditions fully and without reserve, and ;
the order is considered definitive on the part of a Consumer and can only be challenged by the latter in the cases restrictively provided for herein.
Once the order has been placed, an e-mail acknowledging receipt of the order and containing all this information will be automatically sent to the Consumer as soon as possible by Powerled-horticole.com. The sending of this acknowledgement of receipt does not constitute acceptance of the order and validation of the transaction.
The order is accepted and the transaction validated by sending an order confirmation e-mail to the Consumer’s e-mail address. This order confirmation marks the existence of a contract between Powerled-horticole.com and the Consumer.
2.2 Orders by e-mail, or by mail
The Consumer can proceed to the order of Products :

The Consumer must indicate in his/her order in a precise manner: his/her identity, his/her contact details (home address, delivery address if different from the home address, e-mail address and telephone number(s)), the nature, reference and quantity of the products ordered with reference to the catalogue appearing on the website, and the means of payment he/she will use.
Upon receipt of this order, Powerled-horticole.com shall automatically send an acknowledgement of receipt to the Consumer at the e-mail address indicated by the Consumer in his/her order. The latter is in no way validating and definitively confirming the order by Powerled-horticole.com.
Powerled-horticole.com then analyses the order:
Either the order is incomplete and requests additional information from the Consumer in order to validate the order;
or the order is complete and sends the Consumer by e-mail a confirmation of the order including all the details of the order, in particular the Products ordered and their total price, and to which a copy of these General Terms and Conditions is attached. In the event of a request for additional information, this validation can only take place if the Consumer has provided all the additional information, if any.
In any event, Powerled-horticole.com shall attach a copy of these General Terms and Conditions to the order validation e-mail.
It is then up to the Consumer to definitively confirm his/her order by sending his/her agreement to the validation e-mail sent by Powerled-horticole.com, by declaring that he/she accepts these General Terms and Conditions, and by proceeding to his/her payment according to the payment method of his/her choice among those proposed.
This action is equivalent to the handwritten signature referred to in Articles 1174 and 1359 et seq. of the French Civil Code and the conclusion of a commitment in electronic form within the meaning of Articles 1128 et seq. of the French Civil Code.
As of this action, the order is considered final on the part of the Consumer and can only be challenged by the latter in the cases restrictively provided for herein.
2.3 Ordering by telephone
The Consumer may order Products by telephone by calling the following number: +33 (0)767011088.
At the time of his call, the Customer must provide a set of information necessary for his order to be taken into account: his identity, his contact details (home address, delivery address if different from the home address, e-mail address and telephone number(s)), the nature, reference and quantity of the products ordered with reference to this purpose, in particular the Product catalogue appearing on the website, and the means of payment he will use.
At the end of the call, Powerled-horticole.com will send the Consumer, at the e-mail address provided by the Consumer, a confirmation of the order including all the details of the order, in particular the Products ordered and the total price, to which a copy of these General Terms and Conditions will be attached.
It is then up to the Consumer to definitively confirm his/her order by sending his/her agreement to the validation e-mail sent by Powerled-horticole.com, by declaring that he/she accepts these General Terms and Conditions, and by proceeding to his/her payment according to the payment method of his/her choice among those proposed.
This action is equivalent to the handwritten signature referred to in Articles 1174 and 1359 et seq. of the French Civil Code and the conclusion of a commitment in electronic form within the meaning of Articles 1128 et seq. of the French Civil Code. As of this action and subject to its complete payment, the order is considered final on the part of the Consumer and can only be questioned by him/her in the cases restrictively provided for herein.

4.Awards
The Products are invoiced according to their current prices, in particular those mentioned on the website, on the day of their order by the Consumer.
The prices of the Products on the website or in the catalogues of Powerled-horticole.com are indicated in Euros, including all taxes. They do not include shipping costs, warranty and additional services which are invoiced in addition and clearly indicated before the validation of the order by the Consumer.
Shipping costs may be offered by Powerled-horticole.com.
Powerled-horticole.com under the conditions set out in Article 16 below. Such an indication will be specified when the Consumer places his/her order.
The total price to be paid by the Consumer is in any case mentioned before the validation of his/her order.
Powerled-horticole.com reserves the right to modify the price of the Products at any time, it being specified that no modification of the price subsequent to the placing of an order by a Consumer may be made. In case of modification, the applicable price will be the one in force on the day of the Consumer’s order.
Any offers, particularly promotional offers, are only valid within the double limit of the period of validity of the offer concerned and the available stocks.
5.Availability
Please note that we will honour your order within the limits of our available stocks. In the event that one of the products ordered is not available in our stocks, we undertake to contact you by e-mail within 7 days from the date of your order in order to inform you of this and to tell you how long, this product could, if necessary, be delivered to you.
The Consumer then has the option :
– Either to be delivered of a Product of equivalent quality and price, within the limit of available stocks;
– or to wait until the delivery date, the delivery time will be specified;
– or to be reimbursed for the price of the item ordered within 14 days following the order.
6.Responsibilities
Powerled-horticole.com shall not be held liable in any way whatsoever when the non-performance of the Consumer’s order is attributable to the Consumer’s fault.
In general, Powerled-horticole.com may only be held liable in the event of a fault attributable to the latter and proven by the Consumer. In the event that Powerled-horticole.com’s liability is engaged, and except in the event of a specific stipulation or imperative legal provision, Powerled-horticole.com shall only be liable for material, foreseeable and direct damage suffered by the Consumer, to the express exclusion of compensation for all indirect and immaterial damage and prejudice, such as financial prejudice, infringement, etc…
In any event, the use of the Products is made under the sole responsibility of the Consumer. Under these conditions, the Consumer is obliged to ensure that the Products ordered by him/her are maintained in good condition, to use them in accordance with their intended purpose, in compliance with the legal and regulatory provisions and the prescriptions given by their manufacturer (in particular in the instructions for use accompanying the Product, where applicable).
Under these conditions, Powerled-horticole.com declines all responsibility for the fact that :
– normal wear and tear of the Products,
– use not in accordance with the use for which the Products are intended;
– damage or accidents resulting from negligence, lack of supervision, maintenance or improper use;
– damage resulting from modifications, incorporations or mixtures of Products;
– damage resulting from failure to comply with the recommendations for use of the Products mentioned in the description of the Products and/or the regulations relating to the Products;
– malicious acts by the Customer or third parties.
7.Terms of delivery and delivery times in Metropolitan France (including Corsica)
Your orders are processed by the services of Powerled-horticole.com as soon as possible from Monday to Friday inclusive.
Your order placed before 12 noon, by credit card or paypal from Monday to Friday will be dispatched during the day, subject to the availability of the Products concerned.
All orders placed after Friday 12 noon will be processed on the following Monday morning.
Once your order has been dispatched by Powerled-horticole.com, it will be forwarded in accordance with the above mentions. The total delivery time of the order would therefore be a maximum of 72 hours (depending on the delivery method chosen below). These delivery times are understood to be working days, depending on the availability of the Products.
The Products are delivered to the delivery address that you indicated when you placed your order.
Powerled-horticole.com shall not be held responsible for any delay or failure to accept delivery due to a case of force majeure, as stipulated in article 11 below, or to a fault of the customer.
In any event, in the event of failure to deliver within the expressly agreed delivery period, or in the event of failure to agree on a delivery period, in the event of failure to deliver, the Consumer may give formal notice to Powerled-horticole.com, by registered letter with acknowledgement of receipt, to proceed with delivery within a reasonable additional period of time. Should Powerled-horticole.com fail to deliver within this new deadline, the Consumer may cancel the contract by registered letter with acknowledgement of receipt. The contract will be considered as cancelled on receipt by Powerled-horticole.com of this letter, unless it is executed in the meantime; the sums paid by the Consumer will then be reimbursed without interest or compensation at the latest following the date on which the contract was cancelled.
When placing an order, the Consumer must check the completeness and conformity of the information he/she provides to Powerled-horticole.com. Powerled-horticole.com cannot be held responsible for any data entry errors and the consequences in terms of late or incorrect delivery.
In this case, all costs incurred for the reshipment of the order will be entirely at the expense of the Consumer.
7.1 Delivery by Colissimo Standard or So Colissimo :
This choice of delivery allows you to receive your package within 48h maximum thanks to the Post Office and the Colissimo service or So Colissimo, for any order placed before 12h.
7.2 Bulky parcels (delivery by PACKLINK carrier) :
Standard delivery is made within a maximum of 72 hours. Delivery is made at the landing door of the delivery vehicle, with your help if necessary.
We remind you that classic delivery does not include delivery of the package directly to the Consumer’s premises. Your parcel will be delivered to you in front of your home if it is a house, or at the foot of the building if you are in an apartment. Consequently, it is then up to you to ensure by your own means the transfer of the Products thus delivered to your premises.
8.Reception of the Products:
The Consumer is required to personally ensure the reception of the Products ordered at the agreed delivery place. The Consumer will have to be provided for this purpose with a document proving his identity.
If the Consumer is unable to receive the order, he will mandate a third party with a power of attorney and a photocopy of the identity card of the said Consumer.
In the event of absence of the Consumer or his representative at the time of delivery, a calling card will be left. In this case, the carrier may indicate a new delivery date, invite the Consumer to contact him/her to agree on a new delivery date, or it will be up to the Consumer to collect the package at the place and within the time limits specified in the delivery notice. If the deadlines are exceeded or in the absence of a new delivery date agreed with the Consumer, the Products will be returned to Powerled-horticole.com and it will be the Consumer’s responsibility to contact Powerled-horticole.com’s customer service department for possible reshipment of the Products.
Powerled-horticole.com may under no circumstances be held liable in the event that the Consumer or his/her representative is not present to receive the Products ordered or in the absence of determining a new delivery date with the carrier. In this case, the costs that may be incurred for this new delivery shall be borne in full by the Consumer.
Each delivery is deemed to have been made as soon as the Products are handed over to the Customer or his representative, as evidenced by the system used by the carrier, if applicable, such as the delivery tracking system offered by the French Post Office for its “Colissimo” delivery method.
It is up to the Consumer to check the state of the Products on the day of their reception, and to formulate any dispute, reservation or refusal on the carrier’s delivery slip, specifying precisely the reason for the reservation (e.g.: damaged packaging, broken product). At the same time, the Customer must inform Powerled-horticole.com within a maximum period of 48 hours, by sending an e-mail to the following address: contact@powerled-horticole.com or by contacting its customer service department on the following number: +33 (0)767011088, of the damage noted and the purpose of the damage.
In the event of a proven defect, Powerled-horticole.com will replace the defective Product and send a new copy to the Consumer. Powerled-horticole.com will also send the Consumer a return form for the defective product, the related transport costs being borne by Powerled-horticole.com. In this case, it is the Consumer’s responsibility to return the Product concerned within 8 days from the date of this return form. Powerled-horticole.com reserves the right to request payment of the price of the non-returned Product from the Consumer.
The Consumer must keep in his/her possession the proof of the deposit of the returned Product in the post office or later from the carrier, and to communicate this proof on request from Powerled-horticole.com.
9.Methods of Payment and Security
The Consumer can proceed to the payment of his order according to one of the methods of payment envisaged hereafter.
9.1 By credit card :
The consumer proceeds to the payment according to the procedure provided for this purpose.
In case of payment by credit card, the debit of the Consumer’s account with the price of his order will be made at the time of shipment of the latter.
The payment is carried out with the choice on the secure bank server of our partner Stripe. This implies that no banking information concerning you will be transmitted via the Powerled-horticole.com website. Payment by credit card is therefore perfectly secure, your order will be recorded and validated as soon as the payment is accepted by the bank. The customer will receive his credit card transaction ticket by e-mail at the address indicated by the customer when ordering.
-Fight against fraud in means of payment on the Internet and request for proof of payment
In order to secure the use of its customers’ means of payment, Powerled-horticole.com may be required to ask for any proof of identity and/or domicile and/or the means of payment used. Failure or refusal to provide the requested proof may lead Powerled-horticole.com to refuse the order in question. The time limit for transmitting the requested documents to Powerled-horticole.com may delay the dispatch or delivery of the products ordered by the same amount.
Powerled-horticole.com is the sole recipient of the supporting documents which may be requested after the order has been placed.
Security :
Your credit card details are encrypted using 128-bit SSL (Secure Socket Layer) protocol and never pass through the network. Payment is made directly to the bank Powerled-horticole.com has no access to these details and does not keep them on its servers.
This is why you will be asked for them each time you make a new transaction on our site.
Furthermore, our site is now equipped with the SecureCode system which aims to protect you against possible fraudulent use of your bank card.

Powerled-horticole.com reminds you that the fraudulent use of another person’s bank card number without their consent is legally an offence of fraud punishable under article 313.1 of the penal code by a 5-year prison sentence and a 382,000 euro fine.

10.Right of withdrawal
In accordance with the provisions of Articles L.221-18 and following of the Consumer Code, you have a withdrawal period of 14 days from your order, except for orders of certain products, in particular according to these articles:
“The right of retraction cannot be exercised for contracts: (….)
(…) For the supply of goods made to the consumer’s specifications or clearly personalised”.
The withdrawal period begins from the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last good.
To exercise your right of withdrawal, you may send us the standard withdrawal form or any other unambiguous statement expressing your wish to withdraw before the expiry of the 14-day period indicated above.
You must then return the Product(s) concerned to : Powerled-horticole.com – 375 Montée des Hauvets – 26190 La Motte-Fanjas – FRANCE, without undue delay and, in any event, no later than fourteen days after you have communicated your decision to retract your Order.
If all the conditions required for the return of the Products are not met, Powerled-horticole.com may deduct from the sums to be reimbursed, where applicable, a proportion of the sale price corresponding to the sale price of the missing Products, as well as the repair, replacement, and/or restoration of any damaged Products.
Once your withdrawal has been sent, we will refund the full price of the order including delivery costs (except for any additional costs arising from the fact that you have chosen, where applicable, a method of delivery other than the cheaper standard method of delivery offered by us) without undue delay and, in any event, no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will make the refund using the same means of payment that you used to pay for your order, unless you expressly agree to another means of payment; in any case, this refund will not incur any costs for you. In accordance with the provisions of Article L.221-4 of the French Consumer Code, we may defer reimbursement of the price concerned until we have received the Product(s) that you have retracted or until you have provided proof that the Product(s) have been dispatched, whichever comes first.
In order to exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (for example, a letter sent by post or e-mail) by post to the address Powerled-horticole.com – 375 Montée des Hauvets – 26190 La Motte-Fanjas – FRANCE or by e-mail to contact@powerled-horticole.com.
You can use the model withdrawal form but it is not compulsory. For the withdrawal period to be respected, it is sufficient that you send your communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period. You must return or return the goods, to Powerled-horticole.com – 375 Montée des Hauvets – 26190 La Motte-Fanjas – FRANCE, without undue delay and, in any event, no later than fourteen days after you have communicated your decision to withdraw from this contract. This time limit is deemed to have been respected if you return the goods before the fourteen-day period has expired. You shall bear the direct costs of returning the goods.
11.Force majeure
In the event of the occurrence of a case of force majeure preventing the execution of obligations by Powerled-horticole.com, the contract will be immediately suspended, as of the notification made by Powerled-horticole.com to the Customer. In the same way, Powerled-horticole.com will inform the Consumer of the cessation of this event and the execution of the contract will resume immediately on the date of this notification.
Any event beyond the control of Powerled-horticole.com, which could not reasonably have been foreseen at the time the contract was concluded, whose effects cannot be avoided by appropriate measures, and which prevents the debtor from fulfilling its obligation, is considered to be a case of force majeure.
In addition to the cases usually held by French case law to be cases of force majeure, it is agreed to consider the following events as such insofar as they are likely to hinder the performance of the contract: fire, storm, flood, earthquake, total or partial strikes, internal or external to the company, company lock-out, disruption of means of transport or communication routes, acts of government, changes in the regulations applicable to these General Terms and Conditions of Sale or to the Products.
If such an event were to continue beyond a period of one consecutive month after the date of its notification by Powerled-horticole.com to the Consumer, the contract shall be considered terminated by operation of law. Any sums received by Powerled-horticole.com before this date will then be refunded to the Consumer.
12.Guarantee
The Products marketed by Powerled-horticole.com are covered by a two-year guarantee as from the date of the Consumer’s order for the Product concerned. In this case, it is up to the Consumer to consult the website to find out the terms and conditions of the commercial guarantees thus granted.
In the event of a request for the implementation of the guarantee granted, the Consumer must send his/her request to Powerled-horticole.com’s after-sales services, which will analyse the Consumer’s guarantee request and formulate a response as to the assumption of responsibility for the defect invoked by the Consumer within the guarantee.
The product under guarantee will be either exchanged or repaired.
In any case, the guarantees, if any, granted by Powerled-horticole.com do not cover :
– the replacement of consumables.
– the defect linked to abnormal and non-conforming use of the Products
– the defect related to normal wear and tear of the Products
– damage or accidents resulting from negligence, lack of supervision, maintenance or improper use.
– damage resulting from modifications, incorporations or mixtures of Products.
– damage resulting from failure to comply with the recommendations for use of the Products mentioned in the Product description and/or the regulations relating to the Products.
– defects and their consequences due to the intervention of the Consumer or a non-approved repairer.
12.1. Legal warranty
Powerled-horticole.com is bound by the legal guarantees in force, i.e. the legal guarantee of conformity (articles L. 217-4 and following of the Consumer Code) and the legal guarantee of hidden defects provided for in articles 1641 and following of the Civil Code.
When acting under the legal guarantee of conformity, the Consumer :
– has a period of 2 years from the delivery of the good to act.
– can choose between repairing or replacing the good. Powerled-horticole.com may nevertheless not proceed according to the Consumer’s choice when this choice entails a cost that is manifestly disproportionate to the other method given the value of the good or the importance of the defect.
– is exempted from providing proof of the existence of the lack of conformity of the goods for 24 months from the date of delivery of the goods.
When acting as a guarantee for hidden defects, the Consumer may choose between cancellation of the sale or a reduction in the sale price, in accordance with Article 1644 of the Civil Code.
Any Product return must be subject to the express prior agreement of Powerled-horticole.com. It will give rise to the repair or replacement of the Products concerned, after qualitative and quantitative verification of the returned Products. The costs and risks of the return remain the responsibility of the Buyer if the non-conformity is not proven.
The Products must be returned by the Consumer in the event of non-conformity, within the aforementioned time limits, and in the following conditions in their original packaging, complete (accessories, instructions, etc.), neither damaged nor deteriorated, accompanied by the corresponding original invoice.
It is specified that this guarantee of non-conformity or latent defect cannot be implemented when the defect affecting the Products results from the Consumer’s own fault, in particular in the event of storage or conservation of the non-conforming Products.
13.Data processing and Liberties
The personal information collected by Powerled-horticole.com when a Consumer places an order is necessary for Powerled-horticole.com to manage his/her order. Powerled-horticole.com may also use the information collected to communicate it to sub-contractors involved in the execution of the order, in particular to the carrier for the purposes of proper delivery of the Products, for canvassing purposes in order to inform him of its new offers, and also to communicate it to commercial partners subject to having obtained the prior consent of the customer.

In accordance with the French Data Protection Act n°78-17 of 6 January 1978, the Consumer has the right to access, rectify, oppose and delete data collected concerning him/her from Powerled-horticole.com.
The Consumer may also object to the data concerning him/her being used by Powerled-horticole.com at a later date to inform him/her of new offers, and may also object to his/her personal data being transferred to third parties or commercial partners of Powerled-horticole.com.

14.Default of payment
